John addressed the legal and compliance implications of employers moving to a “defined contribution” style for providing health benefits for active employees and/or retirees. The promoters of such “private exchange” arrangements are quick to tout potential reductions in liability and plan sponsor administrative obligations. However, many legal and compliance issues remain. This call explored the concept of insured and self-funded “exchanges,” addressed the legal compliance issues associated with each type of arrangement, and provided an update on the potential impact of recent Executive Order directions on such arrangements.
