The program will include a survey of recent case law in the area of motions for attorney’s fees in IP Litigation cases. Topics covered will include what may or may not be considered an “exceptional case” for an award of attorney’s fees pursuant to 35 U.S.C. § 285, how an award of attorney’s fee is calculated, and when a party may bring a motion for attorney’s fees. The program will discuss best practices and advice for bringing a successful motion for attorney’s fees and, conversely, how to defend against such a motion brought by an opposing party.
