Limits on Confidentiality and Non-Disparagement Provisions
We will discuss confidentiality and non-disparagement provisions contained in restrictive covenant agreements and employee separation and settlement agreements. Our conversation will focus on the Speak Out Act, the NLRB’s decision in McLaren Macomb and subsequent guidance from the NLRB’s General Counsel, and state laws restricting employers’ use of confidentiality and non-disparagement provisions.
Protections for Pregnant and Nursing Employees
On December 29, 2022, the PUMP Act and Pregnant Workers Fairness Act (PWFA) were signed into law. The PUMP Act went into effect on April 28, 2023, and the PWFA will become effective on June 27, 2023. Join us on the PWFA’s effective date as we discuss these new laws, along with other protections for pregnant and nursing employees, including the Americans with Disabilities Act, Fair Labor Standards Act, Family and Medical Leave Act, Pregnancy Discrimination Act, and state laws.
