Navigating Europe’s Complex Antitrust Rules on Cross-Border Trade, Online Distribution, and Pricing
We are witnessing increased scrutiny by European competition authorities into distribution strategies, particularly in the FMCG space. Recently, the European Commission (EC) fined a US sweet snack producer €337.5 million (approx. $365 million) for restricting cross-border trade across the EU, and three luxury fashion houses €157.4 million (approx. $178 million) in total for resale price maintenance practices. Last month, the EC carried out dawn raids in the chocolate confectionery sector on suspicion of illegal restrictions of cross-border trade within the EU. Post-Brexit, the UK Competition and Markets Authority’s enforcement in vertical cases remains strong, particularly against resale price maintenance and online sales restrictions.
