Join us for a discussion of obviousness in patent law and the evolving strategies used to challenge and defend patent validity.
This program will provide an overview of common obviousness rationales and discuss the arguments and counterarguments that are often most effective when evaluating patent validity. Panelists will examine concepts such as teaching away, hindsight, and other analytical frameworks that frequently arise in obviousness disputes. The discussion will compare approaches taken before the USPTO, the PTAB, district courts, and the Federal Circuit, highlighting practical considerations for developing persuasive positions and responding to validity challenges.
