The National Law Journal’s April 17th issue on top defense winners in 2005 included Jud Graves and Anna Sumner who represented the defense in Thebaud v Mt. Vernon OB-GYN Associates, a medical malpractice case. The article quoted Jud as saying, “the complaint read as the worst case scenario I’d seen in 30 years.” To help organize and prepare for this difficult case, Jud and Anna used a mock jury, which found 23-1 in favor of the plaintiff. Using what they learned with the mock jury and careful preparation, they went on to win their case. According to Jud, “Securing a defense verdict required careful jury selection, a deft presentation of the plaintiff’s medical and psychological history and a delicate admission of the doctor’s errors.”
