The U.S. Supreme Court heard oral arguments in Spokeo, Inc. v. Robins, exploring whether a plaintiff can maintain a lawsuit in federal court based solely on the violation of a federal statute where the plaintiff has suffered no actual injury or harm .
If the Supreme Court decides there are grounds for a lawsuit or class action in the case, the door will be opened to many more class actions, said Derin Dickerson, partner in Alston & Bird’s Litigation & Trial Practice.
“Depending on the outcome, we could see a significant uptick in no-injury class actions, which may in turn open up businesses to significant risk.”
