Press Release August 28, 2018Diebold Nixdorf Victorious over Nautilus Hyosung in Federal Circuit AppealAlston & Bird client Diebold Nixdorf Inc. won a significant victory over competitor Nautilus Hyosung in a patent dispute before the U.S. Court of Appeals for the Federal Circuit. In a unanimous ruling, the court agreed with Diebold Nixdorf that all the asserted claims of the patent at issue were invalid as indefinite. The Federal Circuit decision reverses a 2017 finding by the U.S. International Trade Commission (ITC) that Diebold violated Section 337 of the Tariff Act of 1930, as amended.
