This chapter will analyze Sections 542 and 543 of the Bankruptcy Code and Bankruptcy Rules 6002 and 7001(1) that govern the turnover of property and money to the estate by parties other than the debtor, including tactics for plaintiffs and defendants. It will also discuss subsections 546(c) and (d) of the Bankruptcy Code that address the reclamation rights of a seller of goods to a buyer that went into bankruptcy, including requirements, procedure, remedies, and strategies for plaintiffs and defendants.
