• Representing a publicly traded bank in a RICO, fraud, and antitrust class action pending in the Southern District of New York alleging billions of dollars in damages for customers of a foreign exchange trading platform.
• Representing a private equity firm in federal litigation brought by global medical device manufacturers asserting fraud and RICO claims and seeking billions of dollars in damages arising from the firm’s investment in a health care technology company.
• Representing a Fortune 100 health care company in lawsuits across the country involving providers seeking hundreds of millions of dollars in reimbursement for COVID-19 testing services.
• Represented a publicly traded biopharmaceutical company and its board of directors in Nevada M&A and proxy litigation, securing a complete victory after expedited discovery and a multiday evidentiary hearing.
• Represented one of the world’s largest derivatives dealers in a payment-default dispute with a multinational real estate and petroleum investor, negotiating a mutually beneficial settlement that avoided protracted litigation.
• Represented a Fortune 100 beverage manufacturer in federal litigation arising from an arbitration against a commercial supplier.

White Collar

• Representing current and former executives of a global health care technology company in DOJ and SEC investigations and related multidistrict and securities litigation.
• Representing the former chief risk officer of a financial institution in DOJ, SEC, and FDIC investigations arising from the 2023 failures of regional banks associated with digital asset deposits.
• Representing the former CEO of a public company in an SEC investigation and related securities class action.
• Represented U.S. Soccer in an independent investigation into allegations involving the head coach of the USMNT.
• Represented a former mortgage bond trader at a major investment bank in a high-profile SEC securities fraud action in the Southern District of New York, resulting in the SEC’s voluntary dismissal with prejudice of all claims against the client following extensive discovery.
• Represented a publicly traded pharmaceutical company in SEC and DOJ investigations involving insider trading and other regulatory and compliance issues.

Christopher Borchert focuses his practice on high-stakes commercial litigation, white-collar defense, and government and regulatory investigations. He represents financial institutions, private equity firms and their portfolio companies, health care companies, and other businesses in highly regulated industries. Chris litigates a wide range of corporate and commercial disputes, including securities, shareholder, and derivative actions; corporate control and M&A disputes; real estate litigation; and other complex business matters.

Chris also represents companies and individuals in criminal and civil investigations by the Department of Justice, as well as regulatory investigations and enforcement actions by the SEC and other federal and state agencies.

Before joining Alston & Bird, Chris completed a two-year clerkship with the Hon. Esther Salas, U.S. District Judge for the District of New Jersey. He also served on the Connecticut Moot Court Board at UConn Law and was selected as the student commencement speaker for his graduating class.

Chris also enjoys volunteering as a big brother with Big Brothers Big Sisters.
