Banking & Financial Services Litigation

• Represented a private financial services firm in a $500 million summary judgment claim in the commercial court that arose out of a failure to pay under a settlement agreement.
• Represented a security agent in a pre-action disclosure application brought by minority lenders in the recapitalization of the Hurtigruten Group.
• Defended a commercial bank against a claim alleging breach of good faith, Braganza-implied terms, economic duress, and misrepresentation.
• Represented a commercial bank in a dispute arising from on-demand bonds that had not been paid out on account of a company’s sanction status.

Commercial International Arbitration

• Representing Brazilian entities in an upstream oil commercial arbitration seated in London, under the LCIA Rules.

Arbitration-Related Litigation

• Represented a company against two states in an application pursuant to Sections 68 and 69 of the Arbitration Act 1996.

James Brehaut-Elms focuses his practice on complex commercial litigation and international arbitration. He advises on disputes in a range of sectors, including banking and financial services, energy, automotive, and sports. James also maintains an active pro bono practice.

James earned distinction in his LL.M. Commercial Legal Practice and PGDL from BPP University. He also studied classics at the University of Cambridge, obtaining first class honors in his M.A. (Cantab) and a distinction in his M.Phil.
