Patent Litigation Experience

• Managed two successful ITC investigations that focused on standard essential patents involving ITU standard video coding technology, from discovery through trial to Commission Review briefs. At these trials, she handled the direct examination of expert witnesses on domestic industry and public interest issues, who were both cited extensively by the ALJs in winning decisions.
• Took the apex depositions of the CEO, CFO, and the head of regulatory of a major pharmaceutical manufacturing company in a case involving allegations of fraudulent transfer that resulted from winning a seven-figure sanctions award.
• Represented a major technology company in multiple investigations in patent litigation involving video standards technology in the International Trade Commission and related inter partes review proceedings.
• Represented a transplant diagnostic company in preparing an inter partes review petition.
• Represented an Australian mining company in patent litigation involving core orientation mining technology before the International Trade Commission.
• Represented a major technology company in multiple patent litigation matters involving sonar technology in the International Trade Commission, Northern District of Oklahoma, Eastern District of Texas, and the Federal Circuit.
• Represented a Korean technology company in patent litigation involving automatic brightness display technology in the Eastern District of Texas.
• Represented an international defense electronics company in patent litigation involving surveillance systems in the Court of Federal Claims.
• Represented a pharmaceutical company in patent litigation involving a cancer treatment in the Eastern District of Pennsylvania.
• Represented a pharmaceutical company in Hatch-Waxman patent litigation involving an antidepressant in the District of Delaware.

With over a decade of trial experience in New York state courts, federal district courts, and the International Trade Commission (ITC), Jennifer Cieluch focuses her practice on patent and trade secret litigation. She has successfully managed ITC investigations, handled expert witness examinations, and conducted depositions in recent litigation . Using her background in bioengineering, Jennifer represents a variety of companies through all stages of litigation including those related to technology, software, and pharmaceuticals. Jennifer also has extensive stand-up experience, including oral argument before the Federal Circuit.

Jennifer has been recognized in Best Lawyers: Ones to Watch^® for her appellate practice and patent litigation, and she has been recognized as a top performing ITC lawyer by Patexia. She is frequently invited to present on patent litigation topics at national and local conferences, including as a guest lecturer on the International Trade Commission at Duke University School of Law. Jennifer also focuses her pro bono practice to assist veterans, given her background growing up in a military family, and domestic violence victims in family court. Jennifer was a former law intern for the Hon. Richard Linn of the U.S. Court of Appeals for the Federal Circuit.
