- Managed co-pending, offensive district court actions brought by a semiconductor client against a leading technology company for infringement of various cellular data processing technologies.
- Took and defended depositions, engaged in extensive electronic discovery, prevailed on summary adjudication and Daubert motions, and represented the client at trial.
- Defended an AI-based cybersecurity software platform against patent infringement claims brought by a competitor relating to mobile authentication using digital biometrics, resulting in victory on summary judgment. Took and defended fact and expert depositions, prepared expert reports, collaboratively prepared comprehensive summary judgment motion and parallel invalidity challenges, and negotiated final resolution of all claims.
- Litigated an inventorship claim brought by a competitor relating to balloon catheter technology including conducting written discovery, taking the plaintiff’s deposition, and preparing a motion for summary judgment. After a successful dispositive motion practice, the parties’ dispute was settled on a global basis on terms highly favorable to the client.
- Coordinated plaintiff-side litigation in three different patent cases related to network storage infrastructure against multiple defendants and intervenors through all stages of litigation up to trial, resulting in a lucrative settlement for the plaintiff. Managed discovery, prepared and defended fact and expert witnesses, and drafted liability and damages expert reports.
- Managed an ITC investigation brought by the client against a competitor for infringement of patents relating to MEMS technology including conducting discovery, filing pre-hearing briefing, and presenting witnesses at the hearing. The matter was resolved on terms highly favorable to the client mid-hearing.
- Managed offensive copyright claims against a competitor relating to online social gaming platforms, including taking and defending depositions, preparing expert reports, and filing dispositive motions. The matter settled as part of a global settlement reached between the parties on terms favorable to the client.
- Represented a satellite and space technology company in offensive trade secret litigation against a competitor, including taking and defending depositions, preparing for a pre-hearing briefing, and prevailing on motion for case-dispositive sanctions relating to the spoliation of evidence.
- Assisted the client in a complex partnership dissolution dispute including copyright, trade secret, employment, and breach of contract claims resolved through presentation of the matter to a mediator for an advisory opinion. Settled on highly favorable terms for the client.
Artificial Intelligence
- Developed AI policies for several companies regulating the adoption and implementation of AI programs for marketing and business communications.
- Provided counseling to a technology company interested in developing an AI-enabled chat bot to address customer service needs, including evaluating the legal implications of various open-source resources, working with project managers to develop a development and testing plan, and preparing a corporate governance policy regarding use of training data and protection of AI-enabled outputs.
- Litigated multiple patent infringement cases addressing AI-enabled claimed inventions.
