Alaina Gimbert

• Advised a payments company on products, operations, legal frameworks, and regulatory requirements for network and product matters. 
• Advised a payments company on product initiatives at a network level accounting for legal, regulatory, risk, and policy implications to the company as a payment system operator, to depository institutions as participants in the company’s networks, and to consumer and commercial end-users.
• Advised a payments company on funds transfer system and instant payment system, including managing the approval process for network rule changes and leading internal regulatory compliance processes.
• Provided legal support for a payments company’s ACH and check image networks and demand deposit account token service. 

Alaina Gimbert is counsel in Alston & Bird’s Financial Services Payments & Fintech Group. 

With over 20 years of in-house payments industry experience, most recently as senior vice president and associate general counsel with The Clearing House Payments Company, Alaina deeply understands the day-to-day operations of existing and emerging payment networks and the legal and regulatory frameworks that impact the financial technology industry. She also spent nearly a decade with the Federal Reserve Bank of Atlanta, supporting the Federal Reserve Banks’ national ACH and check services.  

Alaina’s experience organizing, building consensus, and executing advocacy initiatives with financial institutions and other industry groups has given her a direct role in policy discussions, including those related to cross-border payments, financial crime, and market infrastructures.  

Alaina represents bank and fintech clients with product development, implementation, and compliance issues related to emerging and evolving payment products and systems, including real-time and cross-border payments, inter-linking arrangements, and the ISO 20022 message standard. She also advises clients regarding payment transparency and financial crimes issues related to payment services, including the U.S. Travel Rule, FATF Recommendation 16, and OFAC compliance. Alaina advises financial institutions, processors, and merchants with ACH and check-based payments, and she negotiates agreements for third party service providers, third party senders, retailers, and financial institutions related to the authorization, acceptance, and processing of ACH and check-based payments.
