- Representing a consumer electronics company in long-running patent litigation against a former market participant. Alston & Bird took over case just months before trial and successfully achieved a jury verdict awarding less than 5% of plaintiff’s requested damages in addition to obtaining findings that newer products did not infringe any asserted claim.
- Represented U.S. wireless carriers and infrastructure providers in patent litigation involving breach of FRAND counterclaims against the patent owner and exclusive licensee as the primary attorney responsible for fact and expert discovery efforts related to damages and FRAND claims. The case resolved with a favorable settlement before trial.
- Represented U.S. wireless carriers and infrastructure providers in patent litigation against exclusive licensee of foreign patent holder with particular focus on damages and FRAND aspects of litigation, including managing expert reports and briefing relating to the same. The case resolved in favorable settlement shortly before trial.
- Represented a major international telecommunications infrastructure provider in numerous International Trade Commission investigations against a mobile communications company. Representation focused on issues relating to public interest, including breach of F/RAND allegations as well as complicated license defense urged by respondent in one of the investigations. Obtained an initial determination rejecting respondent’s license defense in one investigation. All other investigations were resolved based on the mobile communications company entering into a favorable license agreement with the client prior to initial determinations and/or commission review.
- Represented an online internet marketing company in patent infringement litigation and obtained a favorable settlement within 48 hours of filing suit and motion for preliminary injunction.
- Represented an automated live-streaming company and its corporate parents in a patent infringement and successfully participated in defeating plaintiff’s motion for preliminary injunctions. Asserted patents were subsequently invalidated in inter partes review proceedings.
- Represented an optoelectronic sensor company in a multimillion-dollar trade secret and breach of contract case and successfully obtained a multimillion-dollar attorneys fee award which was subsequently affirmed on appeal.
