• Represented a leading issuer of pre-paid debit cards in consumer class actions alleging violations of state unfair and deceptive trade practices statutes.
• Represented a payment processor in a class action alleging that our client aided and abetted a Ponzi scheme relating to telecommunications services.
• Represented a FinTech consumer bill payment solutions provider in litigation involving claims for breach of contract, fraud, and violations of the Computer Fraud and Abuse Act relating to allegations of unlawful access to the plaintiff’s bill payment acceptance interface and system.
• Represented a national bank in arbitration against an identity theft vendor involving services attached to debit and credit cards.
• Represented a privately held travel-stop company against unfair and deceptive trade practice claims in a putative consumer class action involving credit card payment systems.
• Represented a national bank in a contract and fraud case in the Republic of Panama relating to the purchase and use of bank-issued and Visa-branded gift cards.
• Represented a payment solutions provider in a matter involving wire fraud by a user.
• Obtained dismissal with prejudice of putative class action litigation brought against one of the country’s largest ATM owner-operators, alleging the on-screen ATM prompts were fraudulent, deceptive, and unfair.
• Defended a credit card issuer in several cases brought by consumers for breach of contract, fraud, and state-law and common-law claims.
• Resolved a threatened class action for Electronic Fund Transfer Act violations against an ATM operator.
• National counsel for a digital payments company in cases throughout the United States related to allegedly fraudulent transactions.
• Represented a major retailer in unclaimed property litigation in California, New Jersey, Michigan, and Connecticut, and secured millions of dollars in refunds from those states relating to unused store credits. Also secured millions of dollars in refunds from other states through administrative claims.
