Represent Dell in an ITC patent infringement investigation as well as in a parallel district court case involving four patents related to content protection. The complainants, Koninkliike Philips and Philips North America claimed the patents cover a certain content protection scheme. Digital Video-Capable Devices andComponents Thereof, Inv. Represented Dell against Philips N.V. in a case involving high-definition displays. We won the final determination, keeping Dell undefeated at the ITC. Certain Digital Video-Capable Devices and Components Thereof, Inv. No. 337-TA-1224.
Represented East West Manufacturing in an investigation filed by industry giant, Regal Beloit. East West won across the board and was even awarded attorney’s fees – a rarity at the ITC. Certain Blowers and Components Thereof, Inv. No. 337-TA-1217.
Represented Nokia against Lenovo in a matter involving as many as twenty-nine patents pending U.S. ITC litigation. The case settled favorably for our client Nokia with a global patent license agreement prior to the initial ITC hearing. Represented UEI in an ITC case against Roku, which led to the ALJ issuing an initial determination recommending an exclusion order. This was the first time Roku was found to infringe a patent. Defended Garmin in a four-patent case brought by Philips asserting infringement against Garmin’s entire line of wearables and smartwatches, one of the most important and profitable segments for Garmin. During the ITC’s first remote trial, we secured a significant victory when ALJ Lord ruled that the accused devices did not infringe either remaining patent, that neither patent was directed to patent-eligible subject matter, and that one of the patents was invalid. Represented Signify in three separate ITC investigations. These investigations involved as many as seven patents owned by Lighting Science Group. On behalf of Mohawk Industries and related entities, we filed a complaint with the USITC concerning the unlawful importation of flooring products. The ALJ recommended a general exclusion order for the asserted patents based on our motion for summary determination. We won the grant of a rare General Exclusion Order (GEO), the highest form of ITC relief. Certain Luxury Vinyl Tiles and Components Thereof, No. 337-TA-1155.

After obtaining a landmark win at the ITC for client Navico against Garmin, we represented Navico once again in an enforcement proceeding against Garmin. As a result of our strong advocacy, ALJ Shaw recommended the largest civil penalty in ITC history ($37 million). In addition, we won a favorable ruling at Customs and Border Protection (CBP) banning additional infringing products. The parties later settled favorably to Navico. Represented respondent Schick in an investigation brought by The Gillette Company regarding razor cartridges. Obtained a rare delay-of-institution decision from the commission through a noninstitution request for respondent Rockwell Automation Inc. involving allegations of unfair competition and antitrust claims. Representing complainant Rockwell Automation in an investigation against 15 gray market respondents alleging trademark, copyright, and unfair competition claims. Represented complainant Honeywell and related entities in an investigation against The Code Corporation, which involved patents reading on bar code scanning technology. We first obtained a consent order barring many of the respondent’s products, and the case later settled with Code paying Honeywell a significant lump-sum payment along with annual royalties. Represented complainant Nokia against Apple in one of largest investigations in ITC history, involving eight patents and well over 200 claims. Representing respondent Shagang, China’s largest private steel entity, in a highly publicized investigation brought by U.S. Steel for antitrust, trade secret misappropriation, and false designation of origin allegations. Representing Diebold Inc. in an investigation brought by Nautilus Hyosung Inc. Three of the four asserted patents were knocked out of this investigation before trial, and a successful design around was blessed by Customs. Representing complainant Diebold Inc. in this offensive action instituted against Nautilus Hyosung Inc. Diebold alleges patent infringement of five U.S. patents related to automatic depositing apparatus and the transfer of paper media and ATMs. This investigation concluded favorably for our client in finding that the respondent infringed on two Diebold patents and rejected Hyosung’s claims that the patents were invalid. Represented respondent Dell in this investigation brought by complainant Andrea Electronics Corporation involving five patents related to adaptive interference and noise-canceling technology. In May 2016, the commission determined not to review the Initial Determination terminating the action against Dell – the last respondent in the case – based on the complainant’s withdrawal of the complaint. This matter is important because it was only the second investigation to utilize the 100-day program, which the ITC introduced in June 2013. Represented Feit Electric Company Inc., Feit Electric Company Inc. (China), Unity Microelectronics Inc., and Unity Opto Technology Co. Ltd. in this investigation brought by Cree Inc. The complaint alleged patent infringement of eight U.S. patents related to lighting methods and light-emitting diodes (LEDs). The case settled favorably. Represented respondent Robstep Robot Co. Ltd. in this investigation brought by Segway Inc. and DEKA Products Limited Partnership. The complaint alleged patent infringement of four U.S. patents and a U.S. copyright registration regarding personal transport vehicles. This investigation settled favorably to our client. The ALJ ruled that multiple HTC products infringed two of Nokia’s patents, leading to a favorable settlement for Nokia. Represented respondent Imaging Resources LLC in an investigation brought by Canon Inc. that alleged the infringement of two U.S. patents related to toner cartridges and printing technology. Since our client no longer sold the allegedly infringing article, based on our advice, the client ceased defending the case and a default judgment was entered against our client as well as numerous other respondents. Represented complainant Richtek Technology Corp. in seeking relief for patent infringement and trade secret misappropriation by former Richtek employees who started a competing company, uPI Semiconductor. Our team was proceeding full speed toward a trial on Richtek's behalf, but on the day before the trial was to start, uPI unilaterally filed for a consent order with the ITC, voluntarily agreeing to leave the U.S. market for 10 years. The commission approved the consent order. Our client Richtek then found uPI in violation of the agreed upon consent order and asked our team to take further action. The last iteration of this process came when the commission determined to adopt the ALJ’s Recommended Remand Determination Notice adjusting enforcement penalties against uPI. Represented the respondent in a dispute involving welding wire brought by Lincoln Electric. The ALJ found in our client’s favor and the commission affirmed and terminated the investigation. Represented complainants INEOS Fluor Americas LLC, INEOS Fluor Holdings Limited, and INEOS Fluor Limited in an investigation brought against SinoChem for infringement of a patented process of producing an ozone-friendly refrigerant. We obtained a consent order for our client, and later the remainder of the investigation was settled favorably for our clients, securing them the full remedy available at the ITC. Represented respondents Nokia Corporation and Nokia Inc. in a significant investigation brought by Interdigital Communications LLC. During the investigation, we obtained an injunction from the Southern District of New York against Interdigital’s pursuit of the case against Nokia due to an arbitration obligation. Defended respondent Blue Rhino Corp. and related companies based in North Carolina and their supplier, Guangdong Dong Fang Import Export Co. of China. In a novel move, we succeeded in terminating the investigation into one of the patents and certain of the accused products during the discovery period without a hearing and without any findings of a Section 337 violation. We tried the remaining case and won a final determination that our clients’ products do not infringe. Certain Insect Traps, Inv. No. 337-TA-498 (Judge Harris).
