Peter Kazon and Robert Stone were featured presenters at this conference sponsored by American Health Lawyers Association.  Peter presented, "Recent Developments Affecting Clinical Laboratory Testing."  The following topics were addressed.

    • The latest on Medicare’s new requirement for a physician signature on laboratory requisitions
    • The impact of the growth of "personalized medicine" on laboratories and laboratory testing
    • The coverage, coding and payment issues affecting new laboratory technology, such as genetic testing
    • The latest actions from the FDA affecting laboratory testing, including Laboratory Developed Tests (LDTs), and the In Vitro Diagnostic Multivariate Index Assays (IVDMIA) draft Guidance
    • The growth of new types of pathology arrangements, including POD laboratories, TC-PC splits, and the impact of the new anti-markup rules on pathology in particular
    • Recent enforcement activities affecting laboratories

Robert presented, "A Brave New World for Reimbursement:  Key Medicare and Medicaid Programs, Pilots and Demonstrations under Healthcare Reform."  The following topics were addressed.

    • Key reform programs, pilots and demonstration projects under the Affordable Care Act
    • Statutory timeline of dates for implementation
    • Conceptual groupings of reform programs, based on primary elements and approaches to reimbursement reform
    • Compare and contrast the various reform programs
    • How the reform programs are likely to support the underlying policies of the ACA, including potential points of conflict or stress between and among the various programs
    • How CMS will use the new policy tools provided in ACA to drive healthcare delivery system transformation
