The DOJ recently announced that electronic health records (EHR) will be a top target area for False Claims Act (FCA) enforcement in 2020. The COVID-19 pandemic has only further increased the use of EHR technology. In this two-part webinar series, we will first address the federal government’s EHR Incentive Programs, known as “Meaningful Use,” and how the DOJ has pursued alleged FCA violations against participating EHR vendors and their provider customers. In addition to discussing the DOJ’s theories of FCA liability, potential defenses for vendors and providers, and litigation strategies, we will share lessons learned from recent major settlements and corporate integrity agreements involving eClinicalWorks, Greenway Health, and Allscripts, as well as other ongoing FCA cases involving EHR.
