Join our partners, Holly Saporito and Brady Cox, as we discuss two recent decisions that resulted in a loss for the patent owner. In Personalized Media Communications v. Apple, a court found a patent unenforceable due to a prosecution strategy by the patent owner. Meanwhile, in Team Worldwide Corporation v. Academy, Ltd., the court found that a patent owner’s failure to ensure that its licensee marked products with a patent number precluded recovery of six years of pre-suit damages, even though the patent owner had previously complied with the marking statute. Join us as we discuss the lessons that patent owners and patent challengers can learn from these and other cases.
