Apple, a court found a patent unenforceable due to a prosecution strategy by the patent owner. Meanwhile, in Team Worldwide Corporation v. Academy, Ltd., the court found that a patent owner’s failure to ensure that its licensee marked products with a patent number precluded recovery of six years of pre-suit damages, even though the patent owner had previously complied with the marking statute.
