Courts are applying familiar privilege, work-product, and confidentiality rules to artificial intelligence, but a growing number of state and federal decisions are reaching different results depending on who used the tool, what information was entered, and why. This webinar will examine how courts, litigants, and organizations are responding and what litigators and in-house counsel can do now to manage risk. Our panel will discuss recent decisions on whether AI prompts and outputs are privileged or protected work product, emerging discovery demands for AI chat histories (including those of experts and AI providers), and the AI provisions that are fast becoming standard in protective orders. We will also share practical approaches for negotiating those provisions, evaluating AI vendors, and safeguarding trade secrets and other sensitive information throughout the litigation lifecycle.
