Antitrust Litigation

• Defending a leading pharmacy benefit manager against Section 1 and Robinson-Patman Act claims.
• Defending a tire manufacturer in an MDL against Section 1 price fixing conspiracy claims.
• Prosecuting monopolization claims against Keurig Green Mountain on behalf of the McLane Company Inc. in U.S.-based multidistrict litigation.
• Defended Microsoft against a lawsuit filed by civil plaintiffs seeking to block the company’s $69 million billion acquisition of Activision Blizzard, defeating the plaintiffs’ bid for a preliminary injunction.
• Defended a national retailer against tying claims in federal court, achieving dismissal of all claims at the pleading stage.

Data Privacy Litigation

• Defending a top national insurance carrier in two putative class actions alleging invasion of privacy over the use of claims data.
• Representing a health care company in response to a criminal cyberattack, aiding with regulatory reporting duties and defending against resulting litigation.
• Defending clients against privacy claims based on the use of website analytic tools, including claims asserted under the Federal Wiretap Act and the Video Privacy Protection Act.
• Defended a national pharmacy chain in putative class action in California alleging invasion of privacy and violation of Unfair Competition Law; obtained dismissal of a California Consumer Privacy Act (CCPA) claim with prejudice; obtained dismissal of out-of-state plaintiffs’ claims with prejudice on jurisdictional grounds.
• Defended various clients in class actions stemming from alleged data breaches in both state and federal courts.

Robert Poole represents industry leading companies in complex commercial litigation, particularly with respect to antitrust and data privacy issues. His experience ranges from prosecuting and defending against claims under the Sherman Act to litigating privacy claims arising out of data breaches and the use of website analytic tools. He is equipped to advise clients on their relationships with both competitors and consumers, including how companies purposefully use data in a fair, competitive manner. Robert litigates in a variety of federal proceedings, including class actions, multidistrict litigation, and subsequent appeals.
