  • Defeated class certification in a putative consumer class action challenging purported origin claims on kettle chips products.
  • Obtained summary judgment in a consumer class action challenging nutrient content labeling on spray food products.
  • Obtained a complete dismissal of putative consumer class actions challenging purported sustainability and environmental marketing (greenwashing) label claims.
  • Obtained complete dismissals of putative class actions raising an array of adulteration, natural/ artificial, citric acid, flavor, ingredient, additives, and PFAS and other alleged contaminants challenges to food products.
• Representing a renowned global beverage company as part of its national labeling class action defense team, including against putative class claims challenging flavor and ingredient representation and purported PFAS and other contaminants allegations.
• Representing a global casual dining restaurant and sports bar chain against putative nationwide class claims challenging the chain’s boneless wings product.
• Representing global quick service restaurant companies against false advertising class actions raising multiple ingredient, flavor, serving amount, and environmental marketing challenges.
• Representing global pet supplements brands in a class action case challenging the efficacy of one of its pet health supplements products lines.
• Providing ongoing litigation and regulatory counsel to alcohol, food, beverage, and supplements companies regarding regulatory compliance, claim substantiation, and risk mitigation concerning a broad spectrum of labeling and marketing claims.

Alan Pryor is a partner with Alston & Bird’s Litigation & Trial Practice Group and a member of the firm’s Food & Beverage and Class Action Teams. An experienced litigator and trial attorney, Alan represents clients in complex commercial litigation, consumer class actions, and false advertising and intellectual property disputes, with a particular focus on the food, beverage, and supplements industries. Alan also provides strategic counsel to his clients regarding FDA and TTB regulatory matters, claim substantiation, and risk mitigation strategies for consumer-packaged goods.

Before joining Alston & Bird, Alan clerked for the Hon. Dudley H. Bowen, Jr. and the Hon. J. Randal Hall, U.S. District Court Judges for the Southern District of Georgia. In law school, Alan served on the executive board of Georgia Law Review and as research assistant for Dean Rebecca H. White.
