Environmental Compliance and Enforcement

• Advising a client on remedial design performance and advocating on the client's behalf regarding allocation of past and future costs in the longstanding, complex, and ongoing remediation of one of the largest CERCLA Superfund sites in the country.
• Counseling an innovative EV battery company through internal audit of plant discharges, emissions, and product and plant safety.
• Representing a major automaker during investigations and negotiations with the EPA and the California Air Resources Board regarding compliance with greenhouse gas, fuel economy, and criteria pollutant emissions regulations with regular interfacing and close coordination with technical engineering consultants and overseas client contacts to an ultimate settlement with U.S. agency representatives.
• Counseling a municipal power company on numerous environmental issues, including compliance with RCRA hazardous waste management requirements, CAA permitting and reporting, asset sales, and enforcement actions under CERCLA before the EPA and local environmental authorities.
• Assisting a major U.S. manufacturer in conducting an internal investigation and subsequent discussions with state and federal authorities regarding potential CWA and TSCA violations involving alleged PFAS contamination.
• Drafting a white paper for a major U.S. company providing an overview of the regulatory landscape at the federal and state level regarding autonomous vehicles. The white paper included a description of the relevant technology, potentially applicable rules and exemption opportunities, and policy perspectives.
• Providing comprehensive, nationwide environmental regulatory counsel to a major U.S. food retailer. Counseling includes advising on federal, state, and local issues involving, air, water, and waste.
• Assisting a Native American tribe in a lawsuit against the U.S. EPA over matters involving the CWA.

Hazardous Waste and Hazardous Materials

• Advising a major global shipping company on several matters regarding hazardous, universal, and medical wastes.
• Analyzing developments in federal, state, and local regulated waste treatment and disposal laws, and advocating for policy changes on behalf of a client in the medical waste industry.

Hillary Sanborn advises clients on a broad array of matters involving the Clean Air Act (CAA), Clean Water Act (CWA), Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), Resource Conservation and Recovery Act (RCRA), Toxic Substances Control Act (TSCA), and state and local environmental laws. She handles numerous vehicle and product emissions and safety investigations involving the Environmental Protection Agency (EPA), the California Air Resources Board (CARB), the Department of Transportation, and the Pipeline and Hazardous Materials Safety Administration (PHMSA).

Hillary has experience tracking and analyzing developments in state and local climate change and ESG laws, including California ESG reporting legislation, emissions standards, and environmental justice initiatives to address compliance issues for numerous clients. She represented automotive, retail, and construction industry clients in emissions investigations before the U.S. EPA and CARB. She regularly counsels clients on environmental disclosures, indemnities, and other provisions for multimillion and multibillion corporate mergers, acquisitions, and sales.

Hillary earned her J.D., magna cum laude, Order of the Coif, from the Georgetown University Law Center, where she served as the executive editor for the American Criminal Law Review. She also participated in the Georgetown Law Appellate Law Clinic. She earned her B.A., cum laude, in American studies and government from Georgetown University.
