• Represented a global insurance and financial services company in several security incidents, including ransomware attacks, involving multiple state attorney general and insurance regulator investigations.
• Advising financial services companies on data security matters, including on cybersecurity policies, incident preparedness, and compliance with data security requirements, such as the New York Department of Financial Services Cybersecurity Regulation.

Privacy

• Advised a global social media company on U.S. state comprehensive privacy law, including issues related to notice and consent, compliance with consumer privacy rights requests, children’s privacy, and digital advertising and marketing.
• Advised retail and food services companies on issues related to biometrics, digital advertising and marketing, and compliance with U.S. state comprehensive privacy laws.
• Advised a global financial services company on compliance with the federal Gramm–Leach–Bliley Act and U.S. state comprehensive privacy laws, including on issues related to privacy disclosures and consumer privacy rights requests.

Technology and M&A Transactions

• Negotiated SaaS agreements, data processing agreements, and other data and technology-related agreements for a food services company.
• Advised an international logistics services provider on outsourcing initiative involving the global deployment and licensing of proprietary software.
• Advised a global fintech company on data privacy and security issues related to the acquisition of an invoice and payment solution software company.
• Counseled a data services company on data privacy and security issues related to the sale of its data protection business to a data security and management services provider.

Dorian Simmons focuses his practice on matters involving data strategy, artificial intelligence (AI), and technology transactions. He advises clients on a variety of data privacy and security issues, including those related to the California Consumer Privacy Act (CCPA) and other U.S. state comprehensive privacy laws, the Federal Trade Commission Act, the Gramm-Leach-Bliley Act and other federal and state laws and regulations related to children, health, and employee privacy.

Dorian advises clients on compliance strategies, policy development and implementation, digital advertising and marketing, and data security preparedness and incident response. He also counsels clients on technology transactions, including the provision and procurement of AI and other technology-based products and services. Dorian leverages his data strategy and technology practice to advise clients in M&A transactions.

Before becoming a lawyer, Dorian taught third and fourth grade in East Harlem, NY. He uses his skills as a former educator to help clients navigate an evolving data privacy and security landscape and on the use of developing technologies.
