Represented a “big four” bank in consumer litigations in multiple states over predatory lending, predatory servicing, wrongful foreclosure, Truth in Lending Act, and Fair Credit Reporting Act claims.
Represented a “big four” bank and its mortgage finance subsidiary in consumer litigations, including litigation over defective documents filed in foreclosure proceedings, Fair Credit Reporting Act matters, credit card fraud matters, Fair Debt Collection Practices Act and state debt collection practices matters, and unfair and deceptive trade practice claims.
Represented a large mortgage servicer in nationwide litigation involving wrongful foreclosure, RESPA, Fair Debt Collection Practices Act, Fair Credit Reporting Act, unfair competition, and other statutory and common-law claims in six states.

Consumer Class Actions & Mass Claims

Represented multiple banks in consumer litigation over checking account overdraft fees in class actions and mass arbitration proceedings.
Represented a regional consumer finance company in a class action in the Southern District of Georgia involving alleged violations of the Telephone Consumer Protection Act, resulting in a favorable settlement.
Represented two national life insurance companies in multiple nationwide class actions involving allegations under the Telephone Consumer Protection Act, resulting in favorable individual settlements.
Representing a regional bank in a nationwide class action in the Eastern District of California against allegations of misrepresentation of solar loan terms, concealing finance charges, and impairing loan transferability. The case asserts claims under the Truth in Lending Act, Fair Credit Reporting Act, and RICO.

Regulatory & Enforcement Matters

Represented banks and officers in investigations and enforcement proceedings by the Office of the Comptroller of the Currency and state regulators.
Independent legal counsel for four financial institutions subject to the independent foreclosure review mandated by consent orders with the Office of the Comptroller of the Currency and the Board of Governors of the Federal Reserve Bank. We were the only law firm to have been approved by both the OCC and the FRB to act as independent counsel for the independent foreclosure review for four separate servicers.

Cybersecurity & Data-Related Disputes

Represented a holding company in a dispute over a possible security breach resulting in fraudulent emails.
Represented a national bank in multidistrict litigation arising from the MOVEit data security incident, one of the most significant cyberattacks in recent history.
Represented a U.S. top 10 commercial bank in connection with a cyberattack on its systems that impacted customer data, resulting in voluntary dismissals in three of the four class actions and a favorable settlement in the fourth.
