The status of what is a “Water of the United States” is as uncertain as ever. Different legal definitions apply in different states. There are efforts are being made by the EPA and the Army Corps of Engineers to redefine its meaning, but the agencies are facing obstacles in the courts, and the litigation is ongoing.
