On February 19, the White House issued an Executive Order on the “‘Department of Government Efficiency’ Deregulatory Initiative,” which requires all federal agencies to identify, by April 20, regulations that should be rescinded. The Executive Order also requires the agencies to identify regulations that should not be enforced. This webinar will explore the legal limitations on agency deregulation through repeal or non-enforcement of federal regulations.

Speakers will cover:

  • Requirements for agencies to follow notice and comment procedures when repealing regulations
  • Agency justifications for sidestepping notice and comment requirements
  • Limits on litigation challenging agency nonenforcement policies
  • Risks to regulated industry presented by near-term non-enforcement of regulations if enforcement policies change in the next Administration
