Wage & Hour Changes

Under the new Trump administration, several significant changes have been made to wage and hour regulations, particularly regarding the Fair Labor Standards Act (FLSA), independent contractors, and federal contractors.

  • In April 2024, the Department of Labor (DOL) issued regulations raising the salary threshold amounts required for the FLSA’s white-collar exemptions. On November 15, 2024, the U.S. Eastern District of Texas vacated and set aside the DOL’s final regulation. The order was initially appealed by the DOL, but on April 24, 2025, the DOL filed a motion to hold the pending appeals in abeyance, noting the agency is reconsidering the rule.
  • The DOL also recently announced that it is reconsidering the current independent contractor rule under the FLSA.
  • The Trump administration also issued an executive order undoing a regulation that raised the minimum wage for federal contractors.

Making Unions Unnecessary

Although union membership overall continues to decline, unions remain aggressive. In recent years, unions have been more active and more successful – since 2019, union elections are up 49%, with a 74% win rate for unions. Employers are also seeing many NLRB unfair labor practice charges involving noncompete agreements, claims of retaliation, and unlawful handbook policies. Unions have also shown that they are not afraid of striking – in 2024, 271,500 workers were involved in 31 major work-stoppages. We will discuss avoiding legal risks regarding union activity in this insightful webinar.
