Alston & Bird achieved a victory for Resideo, Itron, and Ademco in the U.S. Court of Appeals for the Federal Circuit in a patent dispute from the Patent Trial and Appeal Board (PTAB) and a related appeal from the International Trade Commission (ITC). Our clients prevailed at the PTAB and the ITC, and the plaintiff then appealed in an attempt to overturn the decisions in each of those proceedings.
The Federal Circuit affirmed the final written decision of the PTAB finding the claims of the plaintiff’s patent invalid. The Federal Circuit further held that its ruling on the PTAB decision mooted a separate final determination of the ITC that the asserted patents were not infringed.
