Alston & Bird secured two significant, precedential affirmances of U.S. International Trade Commission (ITC) victories in major patent disputes at the U.S. Court of Appeals for the Federal Circuit—on the same day.
First, the court confirmed Alston & Bird’s ITC win for Resideo, Itron, and Ademco. The court found the asserted patent was invalid, upholding the ITC’s finding of no violation and rendering the appeal moot. In a second, unrelated win, this time for Helen of Troy (d/b/a (Pur Water filters), the court affirmed the ITC finding that Brita’s patent was invalid for lack of written description and enablement. In essence, the court affirmed the ITC’s finding that Brita did not actually invent what Brita’s patent claimed.
