Kevin Minoli Quoted in Politico Pro on Loper Bright Ruling

Alston & Bird partner Kevin Minoli is quoted in the Politico Pro newsletter “Energy Regulation Watch,” (subscription required) discussing the D.C. Circuit’s decision upholding the Biden-era particulate matter standard despite the EPA’s own bid to have it vacated. Kevin, a former acting general counsel at the EPA, explained that the ruling clarifies limits on the Supreme Court’s Loper Bright decision, noting that “some people misunderstand Loper Bright to say if there’s ambiguity in the statute, EPA or a government agency lacks authority to regulate. And that’s not what Loper Bright says.”
