Law.com Highlights Alston & Bird in Litigator of the Week Runners-Up

Brian Boone, Andrew Hatchett, and Matthew Hooker were named runners-up in a Law.com article, “Litigator of the Week Runners-Up and Shout-Outs” (subscription required), for their work representing OptumRx Inc. in multidistrict litigation before the Sixth Circuit. The team secured a rare mandamus victory vacating an order that would have allowed 800 plaintiffs to bring new claims against two of the nation’s largest pharmacy benefit managers. The court held that the district court erred when it let hundreds of plaintiffs amend their complaints years after the deadline without looking at each plaintiff’s diligence. The article noted that the court found the district court “clearly abused its discretion under Rule 16” in allowing the belated amendments.
