On July 16, 2026, a major water main rupture in West Hollywood released highly pressurized water into the Sunset Strip area, flooding streets, damaging vehicles and buildings, buckling pavement, and creating a significant sinkhole near Sunset Boulevard and Holloway Drive. Public reports indicate the failure involved a 36-inch Los Angeles Department of Water and Power (LADWP) transmission main that was more than 100 years old. Just one week later, on July 23, 2026, a second water main break involving a 6-inch pipe was reported at Santa Monica Boulevard and Laurel Avenue, just a few blocks from the original incident.
Although the visible flooding and property damage have rightly received considerable attention, property owners should remain alert to a less obvious but potentially more significant risk of subsurface soil erosion and latent structural damage that may not manifest until weeks, months, or even years after these events.
Sinkholes and Soil Erosion May Indicate Significant Subsurface Damage
According to public reports, the Sunset Strip water main break generated sufficient force to create a large sinkhole, collapse portions of a sidewalk, and buckle pavement in the surrounding areas. News reports further indicate that officials attributed portions of the sinkhole formation to erosion caused by the rushing water.
When highly pressurized water escapes from a transmission main, which is a large-diameter pipeline used to transport large quantities of water over long distances, it can erode and transport supporting soils away from foundations, retaining walls, slabs, roadways, and underground structures. In many cases, the most significant damage occurs below the surface and is not immediately visible.
Potential consequences include loss of support beneath foundations, the development of voids beneath slabs-on-grade and paved surfaces, settlement and differential movement of structures, retaining-wall distress, lateral-support failures, increased hydrostatic pressures, slope instability, and progressive cracking and structural movement. These conditions often require evaluation by geotechnical and structural engineers to determine their nature, cause, and full extent.
The Most Expensive Damage May Not Appear Immediately
Following significant flooding, property owners understandably focus first on the most immediate and visible impacts such as water intrusion, remediation efforts, and damage to vehicles and personal property. These issues often demand urgent attention and substantial resources in the immediate aftermath. Less apparent, however, are the potential subsurface consequences of flooding, which may remain hidden for months or even years before manifesting, yet they can pose equal—or in some cases greater—risks to the long-term integrity and value of affected properties.
Warning signs may include new cracks in foundations, walls, ceilings, or floors; doors and windows that no longer operate properly; settlement of slabs or paving; movement or cracking of retaining walls; separation of building components; and recurring moisture or drainage issues. Property owners who observe any of these conditions should consider promptly documenting the issues and consulting appropriate professionals to determine whether further investigation is warranted.
Property Owners Should Consider Immediate Investigation
Depending on the location and extent of the exposure, property owners should consider a number of precautionary steps, including photographing all visible damage, preserving any available video footage or security camera recordings, documenting pre-loss property conditions, retaining qualified geotechnical and structural consultants, monitoring for signs of cracking, settlement, or structural movement, and maintaining detailed records of all repair and remediation expenses.
Prompt investigation is particularly important if flooding occurred near hillside improvements, retaining walls, underground garages, basements, or structures founded on fill soils—those conditions may present heightened risks that are not immediately apparent.
A Government Claim May Be Required Before Any Lawsuit Can Be Filed
Property owners seeking compensation for damage should be aware that special procedural deadlines may apply when damage is allegedly caused by public infrastructure. The California Government Claims Act generally requires a claimant seeking money damages from a public entity to present a written claim before filing suit. Property damage claims generally must be presented to the public entity within one year of the cause of action, and failure to timely present a claim may bar a later lawsuit.
Inverse Condemnation May Provide an Important Avenue of Recovery
In addition to traditional tort theories, property owners should evaluate whether they have claims for inverse condemnation. Under Article I, Section 19 of the California Constitution, private property may not be taken or damaged for public use without just compensation. And unlike traditional negligence claims, inverse condemnation may provide remedies unavailable in tort: namely, the recovery of attorneys’ fees.
California courts have long recognized that inverse condemnation extends beyond formal eminent domain proceedings and may apply when public improvements physically damage private property. For example, in Albers v. County of Los Angeles, the California Supreme Court held that property owners could recover for landslide damage caused by county road construction, while Marshall v. Department of Water & Power recognized inverse-condemnation liability arising from damage caused by a publicly owned utility system.
The reported facts surrounding the West Hollywood ruptures may implicate these principles. Public reports indicate that a century-old LADWP transmission main allegedly failed, releasing massive quantities of pressurized water and causing extensive flooding, erosion, roadway failures, and sinkhole formation.
