Private Equity Firms in Government Investigations – How Does the DOJ View Them and Their Portfolio Companies?

Alston & Bird’s Health Care Group chair Sarah Ernst and senior counsel Jody Hunt (former head of the U.S. Department of Justice Civil Division) discuss the government’s view of private equity firms in its enforcement priorities.

Jody, who is most recently the Senate-confirmed assistant attorney general for the DOJ Civil Division, joined the firm in July and will provide background on his past roles and insight into how the DOJ views PE firms and their portfolio companies across a range of regulated industries, from health care to government contractors to financial services. The conversation explore how PE firms can better protect themselves if they or their companies are involved in an investigation, considerations when acquiring or selling a company under investigation, and how to maintain a best-in-class compliance culture to mitigate risks in the first instance.
