Emily A. Fitzgerald focuses her practice on appellate and commercial litigation. She has represented numerous clients before the U.S. Supreme Court, Texas Supreme Court, and various federal and state courts of appeal. Emily also has extensive trial and arbitration experience.
Emily is Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization. Emily is known for her expertise in error preservation and appellate strategy. She collaborates with trial teams from the earliest stages of litigation through post-trial proceedings to identify, preserve, and protect critical issues for appeal. Her work includes preparing and arguing dispositive motions, motions in limine, jury charges, and post-trial motions, as well as consulting on trial strategy and error preservation. Clients rely on Emily to ensure that key legal and evidentiary issues are properly preserved and positioned for successful appellate review.
Emily also maintains trial and arbitration practices focused on complex commercial disputes for clients in technology, telecommunications, and health care sectors. Emily routinely represents clients in disputes involving contract claims, business torts, and privacy issues.
Before entering private practice, she clerked for the Hon. Jeffrey S. Boyd of the Supreme Court of Texas and the Hon. Lavenski R. Smith, chief judge of the U.S. Court of Appeals for the Eighth Circuit.
During law school, she served as editor in chief of The Review of Litigation.
