- Advised numerous hospitals, health systems, physician groups, and post-acute care providers on Anti-Kickback Statute, Stark Law, and related state fraud and abuse law compliance, including helping health care providers develop compliant marketing programs and value-based care arrangements.
- Counseled private equity firms and other health care industry clients in the analysis of health care regulatory issues related to strategic joint ventures and other complex transactions.
- Drafted and evaluated compliance program policies and procedures for various types of health care industry clients.
- Drafted self-disclosures to the Centers for Medicare & Medicaid Services (CMS) and the U.S. Department of Health and Human Services (HHS) Office of Inspector General (OIG).
- Represented clinical research sponsors, sites, and physician-investigators in drafting and negotiating clinical trial agreements and related fraud and abuse analyses.
- Conducted internal compliance investigations for a variety of health care providers.
MacKenzie Dickerman is a senior associate with Alston & Bird’s Health Care Group. She focuses her practice on health care compliance and regulatory matters.
MacKenzie’s clients include a variety of providers and entities in the health care industry, including hospitals, health care systems, pharmacies, and physician groups. They rely on her advice for a range of regulatory issues, as well as the regulatory aspects of complex health care transactions, focusing particularly on compliance with the federal Anti-Kickback Statute and Stark Law. In addition to state and federal fraud and abuse matters, she regularly advises clients on matters related to Medicare and Medicaid reimbursement, corporate practice of medicine and fee splitting, and state licensure.
Mackenzie was identified as “One to Watch” by The Best Lawyers in America® in Health Care Law. She earned her J.D., with high honors, from The University of North Carolina, where she served as an editor of The North Carolina Law Review and was inducted into the Order of the Coif. She received her B.S. in biology with a minor in mathematics, cum laude, from the University of Georgia.
