Alston & Bird IP Attorneys Issue Third Edition of Book on Navigating USPTO Post-Grant Proceedings

Alston & Bird attorneys in the firm’s Intellectual Property Post Grant Proceedings Team have published a third edition of their book on navigating post-grant proceedings of the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB).

Edited by Alston & Bird IP partners Ben Pleune and Christopher Douglas and published by Wolters Kluwer, the USPTO Post-Grant Trials Handbook, Third Edition focuses on the three post-grant proceedings to challenge the validity of an issued patent: inter partes review (IPR), post-grant review (PGR), and the retired covered business method review (CBM).

The book’s third edition has been updated to reflect new laws, recent opinions, and the continued evolution of strategy for the successful execution and defense of post-grant trials before the PTAB.

The book draws on the direct experience of Alston & Bird attorneys in representing clients before the PTAB. The authors and contributors outline various facets of these proceedings, offering commentary on issues such as drafting petitions and responses, discovery, preparation for oral proceedings, settlement, and requests for rehearing.

In addition to Pleune and Douglas, a team of Alston & Bird patent litigators and prosecutors composed the book’s editorial committee: Kirk Bradley, Natalie Clayton, Ryan Koppelman, James Abe, Pamela Councill, and Christopher Kelly.

They were joined by the following Alston & Bird attorneys who served as book contributors: Dana Zottola, Ravi Fernando, Dan O’Connor, Darlena Subashi, Chris Ziegler, Andrew Ligotti, Joshua Weeks, Zack Higbee, Caleb Bean, Adam Doane, and Sam Merritt.

Jessica Starr, business development associate director, and Diane Cummings, legal administrative assistant, were business managers for the book.
