- Representing a series of publicly traded, private equity, and smaller business clients accused of unfair and deceptive practices, cyber and privacy violations, and/or personalized pricing in investigations and litigation brought by the Federal Trade Commission and state attorneys general.
- Represented a property management company and a law firm in FTC investigations related to use of consumer reviews.
- Defended a large online consumer software company in an FTC and state attorney general investigation related to the sale and use of private customer data in advertising.
- Represented several agricultural equipment dealers in FTC investigations into right-to-repair claims. The investigations were closed without findings.
- Represented a publicly traded automotive group in an FTC investigation related to advertising and sale of add-on products.
- Represented a health care client involved in a ransomware attack, requiring a complex forensic investigation, extensive data review and restoration processes, and a series of disputes over potential breaches of contract resulting from the service outage.
- Represented an Am Law 100 law firm involved in a ransomware attack, requiring a complex forensic investigation, data review, and careful navigation of conflicts and firm politics.
- Represented a major telecom firm in investigations by multiple state-sponsored actors targeting the infrastructure for both espionage and financial crime-based purposes.
- Counseling clients on use of AI and avoiding pitfalls in the areas of antitrust, privacy, data security, and contractual relationships.
- Represented a Fortune 1000 retail company accused of privacy violations in FTC and state AG investigations and related litigation where client defeated class certification and won summary judgment.
- Obtained dismissal of a class action brought against an international payment processing company following a data breach.
- Defended a Fortune 50 retail company against multiple class actions following a major data breach. The matter was settled on terms favorable to our client.
Antitrust
- Prosecuting monopolization claims against Keurig Green Mountain on behalf of the McLane Company in U.S.-based multidistrict litigation (MDL).
- Counsel to a major chicken producer defending allegations in multiple lawsuits that the poultry industry engaged in conspiracies to reduce output, manipulate price indexes, and fix wages.
- Resolved claims in an MDL and in international arbitration on behalf of a Fortune 50 company victimized by a worldwide conspiracy to fix the price of lithium-ion batteries.
- Defended a major pharmaceutical company in a case involving antitrust claims arising out of a patent license dispute.
- Counsel to one of the world’s largest wireless equipment manufacturers in a series of international disputes over the licensing of wireless technologies in ICC arbitration, and before the International Trade Commission and federal courts across the country.
Commercial/Mass Arbitration
- Trial counsel for one of the world’s largest telecom carriers in four week-long merits hearings where the client received full defense verdicts and attorneys’ fees.
- Represented both plaintiffs and defendants in more than 20 commercial arbitrations involving business-to-business disputes ranging from breach of a software agreement to fraud.
- Representing various clients, from Fortune 50 to smaller companies, in defending against mass arbitrations related to consumer claims overpricing and claims of unfair and deceptive practices.
